This Data Security and Privacy Policy (the “Privacy Policy”) discloses the data security andprivacy practices of TreeHub and its mobile application and website (collectively the “Platform”); and is incorporated into the Platform’s Terms & Conditions. Your use of the Platform is governed by these Terms & Conditions, which includes the Data Security and Privacy Policy [], which is incorporated herein by reference. All references to “you” or “your”, as applicable, mean the individual who accesses, uses, and/or participates in the Platform in any manner. You must agree to these Terms & Conditions in order to use the Platform. This Privacy Policy applies solely to data collected by the Platform, except where stated otherwise. It will notify you of the following:

1. Protected Data.

TreeHub uses commercially practicable means to protect all personal data collected on the Platform from being improperly accessed by third parties at any time. All financial transactions will be conducted through a third party Payment Vendor on that Payment Vendor’s secure site. Additionally, to the extent that TreeHub does not foresee a continued use of any such data, it will promptly destroy such data without retaining copies for its files.

2. User Submitted Data.

TreeHub is the sole owner of the data collected on the Platform. TreeHub will only have access to and/or collect data that you voluntarily give it via your user account or other direct contact from you. TreeHub will not sell or rent this data to anyone. TreeHub will not share data collected on the Platform with any third party outside of TreeHub and its agents. TreeHub may make changes to this Privacy Policy, at any time.

3. Information Collected Automatically.

During your visit the Platform, it may automatically collect and store the following types of information about your computer and your visit: (i) the domain and host from which you access the Internet; (ii) the Internet address of the website from which you linked directly to the Platform, if applicable; (iii) the date and time you arrived at the Platform and how long you spent on the Platform and which pages you visited; (iv) Your Internet protocol (IP) address; and (v) your computer's operating system and browser software.

4. Information Collected by TreeHub.

When you sign up for a TreeHub account, you will provide your email address, username, and password. In order to place a pre-order on TreeHub, you will provide your full name, mobile phone number, a selfie of your face, and a copy of your government-issued ID (i.e. your driver’s license, state ID card, or passport). TreeHub will prompt you to use Passbase, a third party identity verification platform. Such information is a part of what’s called your personally identifiable information (“PII”) as this is data that can be used to specifically identify you. TreeHub stores your full name, government-issued ID and mobile telephone number, for the limited purpose of allowing you to place future orders more efficiently.

5. How TreeHub uses the Information it Collects.

TreeHub uses the information it collects from you to: (i) provide the Platform to you, including, but not limited to, connecting you to a Vendor; (ii) support our Vendors with information necessary for them to maintain their records in accordance with their normal business practices and applicable law; (iii) identify you as a user in our system; (iv) comply with applicable laws; (v) analyze and assess current and potential user markets; (vi) evaluate retailer, brand, and other third party partnerships; (vii) personalize your experience with TreeHub; (viii) provide customer support and assist with your access or use of the Platform; (ix) communicate with you, either directly or through a Vendor, including for marketing and promotional purposes; (x) to engage in marketing activities with you and to assess marketing and promotional initiatives; (xi) detect, prevent, or mitigate fraud or any other suspicious activities; (xii) conduct research and development, such as by conducting voluntary user surveys or obtaining other feedback from you; and (xiii) as otherwise described in this Privacy Policy or in any other notices we have or will provide to you.

6. Cookies.

The Platform uses “cookies”. A cookie is a piece of data stored on a website user’s hard drive to help us improve your access to the Platform and identify repeat visitors to the Platform. For instance, when TreeHub uses a cookie to identify you, you would not have to login a password more than once, thereby saving time while on the Platform. Use of a cookie is in no way linked to any personally identifiable information on the Platform. TreeHub has no control over or access to cookies that one of its advertisers may use on the Platform.

7. Arbitration.

Any dispute, controversy or claim arising out of or relating to this Privacy Policy will be resolved by binding arbitration in the District of Columbia. The FederalA rbitration Act will govern the interpretation and enforcement of this section. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes which are then in effect. Arbitration must be initiated by a party pursuant to AAA rules, which can be found at and will govern how to initiate arbitration proceedings. Judgment upon the award rendered may be entered and enforced in any court of competent jurisdiction. YOU ACKNOWLEDGE AND AGREE THAT YOU AND TREEHUB ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

8. Changes to the Policy.

TreeHub may update this Privacy Policy periodically. If TreeHub makes any material changes, it will update you on the Platform, by email, or by other communication. TreeHub encourages you to stay up to date about its security and privacy practices by reviewing this Privacy Policy periodically. Continued use of TreeHub following notices of changes to the Privacy Policy indicates your acknowledgment of such changes and agreement to be bound by the Terms & Conditions of such changes.

9. Age Restrictions.

The Platform is intended for access and use by individuals who are of legal age for the services offered based on the applicable regulations of their state or other government entities (“Qualifying Age”). TreeHub does not knowingly collect PII or other data from or about anyone who is not of Qualifying Age. If you are not of Qualifying Age, you should not attempt to access or use TreeHub, or send any data to us. If TreeHub discovers that it has collected PII or other data from an individual who is not of Qualifying Age, it will take steps to remove that data.

10. Data Security.

All of the information TreeHub collects is protected within its database, and TreeHub is committed to securing that data. Although TreeHub takes reasonable, industry-standard precautions to protect your information, no security measures are 100% secure, and TreeHub cannot guarantee the full security of your information. You are also responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails or physical mail between you and TreeHub at all times. When you direct TreeHub to share your information with third parties, please note that your privacy and security may also be affected by changes in such third party services. TreeHub is not responsible for the functionality, privacy, or security measures of any other organization or third party.
